Fiji police have charged two men for having gay sex even though the country’s high court ruled last year laws prohibiting gay sex in private were unconstitutional. reported the men were arrested near Fiji’s capital Suva.

Police reportedly caught the pair having sex in a private home. They were granted bail after briefly appearing in court.

The arrest comes almost a year after Australian tourist Thomas McCosker and Fijian man Dhirendra Nadan were briefly imprisoned for consensual gay sex in a case that outraged activists.

Fiji’s high court ruled their conviction was unconstitutional last August.
